DCRP Wins Open Records Battle With Dallas DA

The Texas Attorney General ruled on Friday that Dallas DA Craig Watkins must produce his desk calendars and emails relating to public appearances pursuant to the Texas Public Information Act.  The Attorney General found that these materials are "public information," and the Dallas DA failed to show why the information should be withheld from disclosure.

 

This is a major victory for citizens of Dallas County and their right to know what their elected officials are doing during business hours.  We will share with you what we find in the DA's calendars.  In the meantime, you can click here to read the Attorney General's ruling.

DA Craig Watkins is at it again.  The County is facing a $43 million budget shortfall, but Watkins refuses to make the tough decisions necessary to bring his office's budget in line.  Instead, he is more interested in stroking his own personal ego by appearing on national television shows.  Dallas County needs real leadership.  All Watkins has offered is more petty politics.

Those of us of a certain vintage (think Dukes of Hazzard, Jams, and Run DMC) remember the video game "Mike Tyson's Punch Out."  Well, according to The Dallas Morning News's Gromer Jeffers, Dallas DA Craig Watkins may be the modern day "Glass Joe."

Another day, another disturbing story about Democrat District Attorney Craig Watkins and his deception about Constablegate. 


After refusing to allow an independent prosecutor to investigate the numerous allegations of official corruption against two Democrat constables for more than two years, Mr. Watkins finally asked a judge to appoint a special investigator.  Instead of seeking an unbiased investigator, Mr. Watkins selected a personal injury trial lawyer with deep ties to the Democrat establishment.  He even donated to Mr. Watkins's political campaign.

Why did Mr. Watkins -- after two years -- make this decision?  Mr. Watkins claimed that an unidentified person sent a letter detailing a "scheme" by political opponents to spread lies about him.  So who is this mysterious source?  Surely this person had enough credibility to allow Mr. Watkins to declare publicly the existence of an investigation.  

Not quite.  The Dallas Morning News reports today that the source is a man with a long criminal history who is currently in Collin County jail on numerous felony charges including making false statements for property credit, credit card abuse, theft and impersonating a lawyer.  At best, Mr. Watkins appears to have been duped by a fraudster.   At worst, Mr. Watkins used this dubious claim to justify the appointment of a Democrat insider to investigate his political opponents.  The truth may never be known.

More Bad Politics from Craig Watkins

In the latest bizarre twist in the ongoing Constablegate scandal, First Assistant DA Terri Moore announced today that Judge Don Adams had appointed former Democrat State Representative Ted Lyon as a special investigator to investigate “a scheme to implicate public officials, including [Watkins], by lying to investigators.”   Mr. Lyon will also, apparently, investigate Constablegate.

 

Where to start?

 

First, Mr. Watkins has refused to acknowledge the existence of an investigation into Democrat constables Cortes and Evans since receiving allegations against them in February 2008.  Meanwhile, he had no problem having a public press conference one week after receiving a single allegation made by one individual.  Mr. Watkins’ selective release of public information seems to be tied to his own political fortunes.

 

Second, the timing of this appointment is highly suspect.  The appointment comes only one week after the damaging discovery that Mr. Watkins had received a memo in February 2008 from County Auditor Virginia Porter detailing allegations against the Democrat constables. 

 

Third, it is hard to see how Mr. Lyon is the most qualified person to take on this role.  Mr. Lyon is a partisan Democrat who has donated to many Democrat officeholders, including Craig Watkins.  Mr. Lyon is also civil litigator who specializes in medical malpractice, wrongful death, and toxic tort cases.  

 

In the end, this decision appears to be motivated by politics.  This is not being “smart on crime.”  This is a desperate attempt by a failing politician to divert the public’s attention from his political quagmire. 

 

In his press release, Mr. Watkins complains that he is a "potential victim."  No, sir.  The real victims are those whose cars were illegally towed by towing companies who allegedly had special relationships with the Democrat constables.  The real victims are the police officers who work tirelessly in Dallas County to build cases, only to have your office reject them.  The real victims here are the citizens of Dallas County who have had to endure the games from your office.  There have been plenty of victims as a result of your actions or inactions, Mr. Watkins, but of them is certainly not you.


Dallas County deserves better leadership from its elected officials.  This November, help us sweep out corruption at every level.   This November, vote Republican.

Why Does Craig Watkins Continue to Hide the Truth?

Yesterday, The Dallas Morning News reported that the County Auditor provided a report that detailed allegations against Democrat constables Jaime Cortes and Derick Evans to Democrat DA Craig Watkins in February 2008.  Why is this important?  The allegations against the constables went public in the summer of 2009.  This means that Mr. Watkins was sitting on these allegations for nearly 1 1/2 years before the allegations went public.

 

And what does Mr. Watkins have to show by way of an investigation into the allegations?  Nothing.  Not an indictment.  Not a charge.  Not even an acknowledgement of an investigation.  (The cat is out of the bag on the allegations, so it is hard to see why not acknowledging the existence of an investigation would impair law enforcement.)  Mr. Watkins has had more than two years to begin complete his investigation into the allegations.  Instead, he has misled a grand jury, dragged his feet, and refused the Attorney General (twice) to conduct his own investigation.   Simply put, Craig Watkins has failed Dallas County.

 

And how do we know that Watkins did not do anything with the Auditor's report in early 2008?  The Commissioners Court hired retired FBI Agent Danny Defenbaugh late 2009 to conduct an independent investigation after it became clear that Watkins was not conducting an official inquiry.  Defenbaugh released his 92-page report in February 2010, two years after Watkins first received notice of the allegations Defenbaugh found evidence of bribery, official repression, violations of the Hatch Act, and illegal campaign contributions.  Importantly, Defenbaugh also concluded that most of the witnesses he interviewed had not been contacted by investigators from the DA's office. 

 

Of note from yesterday's story was Mr. Watkins adamant denial that his office ever received the auditor's report.  Well, that turns out to be a lie as well.  The News is now reporting that the County Auditor has proof that she hand delivered the report to Watkins's office in February 2008.  Furthermore, when a public information request was made for the report in 2009, Watkins's office denied its release.  Why?  Watkins claimed that the information contained in the report was "confidential."

It is now clear that Mr. Watkins is unfit for this office.  He has done everything possible to impede a corruption investigation into his fellow Democrat officeholders.  And now he has lied to the public about what his office knew about the allegations.  Dallas County deserves better.

TDMN: Watkins Knew About Constable Allegations For Two Years

In the never ending saga involving local Democrat politicians, The Dallas Morning News reported this morning that DA Craig Watkins knew about the allegations involving Constable Jaime Cortes's office in February 2008.  In the two years since, the DA's office has made no apparent attempt to indict, charge, or investigation Constable Cortes, Constable Evans, or any other person involved in the allegations. 

 

This story raises serious questions about Mr. Watkins's knowledge of the allegations.  The taxpayers of Dallas County deserve answers.  The taxpayers of Dallas County deserve better.

In a shocking interview with the Dallas Observer, troubled Democrat Constable Jaime Cortes proudly declared that he was "a 'soldier' who does 'the dirty work' for stars of the county Democratic Party like District Attorney Craig Watkins and Sheriff Lupe Valdez, likening it to his prowess in high school as a blocker in football and rebounder in basketball."

 

So, Mr. Cortes, what is the "dirty work" you perform for Mr. Watkins?  How are you paid for the "dirty work" you perform?  Does the performance of "dirty work" have anything to do with Mr. Watkins's refusal to allow the Attorney General to conduct an unbiased and fair investigation?  These are questions that should be answered by both Cortes and Watkins.

Craig Watkins Still Ignoring the Public

In what is becoming his standard practice, Democrat DA Craig Watkins refused to speak to a reporter about the ongoing scandal involving Constables Evans and Cortes, both of who are Democrats.  (Click here for the full story from The Dallas Morning News.)  It is clear that Mr. Watkins intends on arming himself with terse written statements (written by his media handlers) rather than answering the tough questions demanded by taxpayers of Dallas County. 

Perhaps Mr. Watkins should spend more time in Dallas County tending to the crisis brewing downtown instead of making national television appearances.  Dallas County taxpayers deserve better than this.  Mr. Watkins can play the role of Hamlet for so long.  The taxpayers are entitled to know his role in this year-long scandal and what, if anything, his office has done to investigate the allegations.

The Politics of Craig Watkins Leads to Wasted Tax Dollars

After three years of dealing with the politics of Craig Watkins, the Dallas County Commissioners have had enough.  They voted yesterday to hire a former Tarrant County Judge to be the Commissioners' full time legal counsel, normally a role for the District Attorney.  The real loser in this three year episode is the taxpayer who has to pay for another lawyer because of Mr. Watkins' refusal to work with the Commissioners.

Swing Districts Oppose Health Reform

House Speaker Nancy Pelosi says she plans to bring health-care reform to a vote this week. Democratic leaders cite national polls that show support for individual provisions of the bill as a reason to pass this reform. Yet vulnerable politicians should be warned: Responses to questions about individual benefits, particularly when removed from a cost context, are different from those on the whole bill.

Voters in key congressional districts are clear in their opposition to what they have seen, read and heard on health-care reform. That's one of the findings of a survey that will be released today by the Polling Company on behalf of Independent Women's Voice. The survey consisted of 1,200 registered voters in 35 districts represented by members who could determine the outcome of the health-care debate. Twenty of those members voted for the House bill in November but now may be reconsidering. Fifteen voted against the bill but are under tremendous pressure to change their vote.

Dallas County JP accuses victorious rival of mail-in ballot fraud; winner's manager blasts canvassing of residents

A small group of supporters of a Dallas County justice of the peace whose re-election bid was foiled by mail-in ballots demonstrated against voter fraud Tuesday outside where county commissioners held their weekly meeting.

Inside the county administration building, elections administrator Bruce Sherbet told commissioners that complaints about mail-in ballots are running at about the same rate as in the past. He said there's no reason to suspect widespread fraud during last week's primary elections.

Justice of the Peace Luis Sepulveda, whose precinct includes South Dallas, much of Oak Cliff and other parts of Dallas, has asked the Texas secretary of state to investigate vote fraud in the primary.

Dallas Rep. Jeb Hensarling and others have proposed that the House GOP adopt an immediate, unilateral moratorium on earmarks. House Republicans will meet Thursday to discuss the idea, and it looks like the fix is in. Minority Leader John Boehner. BALLOT ORDER DRAWING - JANUARY 7, 2010

 

Not later than January 8th, which is the 53rd day before the primary election, the executive committee of each county must meet and conduct the following statutory business:

 

1. Draw for ballot order of candidate names in contested races3

2. Set the time and location for the precinct conventions4

3. Set the time and location of the county/SD convention5

4. Approve the voting systems

5. Appoint Election Judges and Alternate Judges

 

Also at this meeting, some counties may wish to establish a Primary Committee, which is optional8. This committee is composed of the County Chairman and four other members of the County Executive Committee.

 

This committee will have two responsibilities: conduct the drawings for each contested primary race, and proofread the ballot before it is sent to the printer.

 

On January 6th, 2010, the State Chairman will certify the list of all statewide and district candidates. The State Chairman will then immediately notify all County Chairmen of the names and offices sought by all multi-county district candidates9.

 

County Chairmen will be in receipt of this list prior to conducting the meeting on

January 8th.

 

At the meeting on January 11th, either the Primary Committee or the entire Executive Committee shall conduct the drawings for each and every contested race on the primary ballot to determine which candidate will be printed first on the ballot, which printed second, and so on until each candidate's position on the ballot for every contested race has been determined.

A representative of each candidate has the right to attend this meeting1. The County Chairman must post a notice of the time, location, and day of the drawing on the Commissioners Court bulletin board twenty-four hours prior to the meeting.

 

Senate Bill 1970 Sec. 2 ammends Section 2.053 ; Election Code, to require that ballot to list the offices and names of candidates "Declared Elected" on the ballot seperatly following the opposed races under a heading "UNOPPOSED CANDIDTES DECLARED ELECTED". These candidates shall appear in the same relative order as they would appear if opposed on the ballot. By Numerical Order.

 

At this same meeting, the County Executive Committee must set the time and location of the precinct conventions. The conventions must be held on the primary election day, March 2nd, at a location within the election precinct, starting between 7:00 p.m. and 9:00 p.m. However, no convention may start until the last voter has voted.

 

Also at this meeting, the starting time and location of the county or senatorial district conventions must be set.

 

The date for county or SD convention is March 20, 2010. ( Time and Location had not been set at the sending of this notice.)


The date for the State Convention is June 10, 11 and 12th.  It will be held at the Dallas Convention Center.

 

Other statutory business which must be conducted includes approval of the use of voting systems and the approval of Election Judges and Alternate Judges.

 

However, if a vacancy occurs for both the Election Judge and Alternate Judge after approval of the County Executive Committee, the Chairman may make appointments without the Executive Committee.

Gov. Perry Appoints Myers as Justice of the 5th District Court of Appeals

AUSTIN - Gov. Rick Perry has appointed Lana Myers of Coppell as justice of the Fifth District Court of Appeals for a term to expire at the next general election.

Myers is judge of the 203rd Judicial District Court of Dallas County, a position she has held since 1995. She is a member of the State Bar of Texas, Dallas Bar Association, Texas Supreme Court Task Force to Ensure Judicial Readiness in Times of Emergency, and Texas Crime Victims Institute Advisory Council. She is also past Local Administrative District Judge for Dallas County and Administrative Presiding Judge of the Dallas County Criminal District Courts, and a past member of the Dallas County Juvenile Board and Volunteer Center of Dallas County Board of Directors. She is co-chair of the Dallas Bar Association Mock Trial Committee and a member of the Baylor University Women's Council of Dallas. Myers received a bachelor's degree and law degree from Baylor University.

The DCYRs Community Service vision is to support organizations that make an impact both locally and globally while espousing the principle that Republicans are about service to the community, but through quality local community programs instead of government-run initiatives.  This holiday season, we would like to show our support for Buckner International's Shoes for Orphan Souls program.  Shoes for Orphan Souls began in 1995 by KCBI radio in Dallas, before being adopted by Buckner International, a progressive leader in the movement towards justice for orphans and widows in the Dallas area and nationwide for the past 130 years.  Through the Shoes for Orphans Souls, 1.8 million+ pairs of new shoes have been given to at-risk children in the United States and to orphans in 68 countries around the world.

The following Dallas County clubs and club members received awards at Thursday's TFRW Legislative Day Luncheon.

Dallas Star Republican Women received First Place Winner for a small club by voluneering 9,047 hours.

Cindy Werner, Dallas Star Republican Women President received First Place Individual with the highest amount of campaign hours. Cindy contributed 2,315 hours.

Gov. Perry Appoints Stanton to 134th Judicial District Court

AUSTIN - Gov. Rick Perry has appointed James M. Stanton of Dallas as judge of the 134th Judicial District Court for a term to expire at the next general election. The 134th district is in Dallas County.  
 
Stanton is an attorney in the commercial litigation section of Cozen O'Connor P.C. He is a member of the American Bar Association, State Bar of Texas, Dallas Bar Association and Dallas Association of Young Lawyers. He is co-chair of the Dallas Young Lawyers' Young Voters Committee, a volunteer with the Make-A-Wish Foundation of North Texas, and a member of the First United Methodist Church of Dallas. Stanton received a bachelor's degree from the University of Colorado at Colorado Springs and a law degree from Baylor University.  He replaces Anne Ashby of Dallas.
 
This appointment is subject to Senate confirmation.

It seems that actor John Voigt's recent op-ed in The Washingtons has caused quite the firestorm in liberal Hollywood.  Best known for his roles in Midnight Cowboy, Mission Impossible, and, most recently, father to Angelia Jolie, Voight was active last year in Rudy Giuliani's campaign for President. 

It will be interesting to see who else in Hollywood will be brave enough to support Senator McCain.
